These Terms and Conditions (“Terms”) govern your use of the website and services operated by Specialized Scuba Inc, a Florida-based scuba diving business (“Company,” “we,” “us,” or “our”). By accessing our website, booking trips, or participating in any scuba diving or related activities, you agree to be bound by these Terms.
1. Nature of Services
We arrange, organize, sell, and/or lead recreational scuba diving activities, both within the United States and internationally, including but not limited to:
- Guided scuba dives in Florida waters
- Guided dives at international destinations
- Group dive travel programs
- Trips involving dive resorts and liveaboard vessels
- Diving conducted from charter boats not owned or operated by the Company
Unless expressly stated otherwise in writing, the Company does not own, operate, or control vessels, liveaboards, resorts, or transportation providers and acts solely as a trip organizer, dive guide, and/or agent for independent third-party providers. The Company is not a common carrier, vessel operator, or insurer of participant safety.
2. Eligibility and Certification
To participate in scuba diving activities, you represent and warrant that:
- You are at least 18 years old (or have a parent/legal guardian’s consent)
- You hold a valid scuba certification from a recognized training agency (e.g., PADI, NAUI, SSI)
- You are medically fit to dive and have no condition that would make diving unsafe
- You agree to comply with all dive briefings, safety rules, and instructions
We reserve the right to refuse participation to any individual for safety or medical reasons.
3. Assumption of Risk
Scuba diving is an inherently hazardous activity that involves risks including, but not limited to, drowning, decompression sickness, embolism, equipment failure, marine life injury, weather conditions, and travel-related risks.
By using our services, you voluntarily assume all risks, known and unknown, associated with scuba diving and related travel activities, whether occurring on land, water, or during transit.
4. Waiver and Release of Liability
To the fullest extent permitted by Florida law, you agree to release, waive, discharge, and hold harmless the Company, its owners, officers, employees, instructors, divemasters, guides, agents, and affiliates from any and all claims, demands, damages, or causes of action arising out of or related to:
- Participation in scuba diving or snorkeling activities
- Use of equipment
- Travel to and from dive sites
- Acts or omissions of third-party providers
Participation is contingent upon execution of a separate written liability waiver and assumption of risk agreement prior to diving.
5. Third-Party Providers
All charter boats, vessels, liveaboards, resorts, hotels, airlines, ground transportation providers, and other service providers are independent third parties not owned, operated, or controlled by the Company.
You acknowledge and agree that:
- The Company has no control over the condition, operation, crew, maintenance, or safety procedures of third-party vessels or facilities
- Any diving conducted from a charter boat is subject to the vessel operator’s rules, crew decisions, and safety determinations
- The Company is not responsible for the acts, omissions, negligence, or failures of any third-party provider
Your participation is subject to the terms, conditions, waivers, and limitations imposed by those third parties, which you agree to review and accept.
6. Bookings, Payments, and Cancellations
6.1 Payments
- Full or partial payment may be required at the time of booking
- Prices are subject to change until payment is received
6.2 Cancellations by Customer
- Cancellation policies vary by trip and third-party provider
- Deposits may be non-refundable
- No refunds for missed dives, early departure, or failure to meet certification/medical requirements
6.3 Cancellations by Company
We reserve the right to cancel or modify trips due to weather, safety concerns, insufficient participation, or events beyond our control. Our liability is limited to refund of amounts paid to us, excluding third-party costs unless otherwise stated.
7. Weather and Sea Conditions
All dive activities are subject to weather, sea state, and environmental conditions. Decisions regarding dive suitability are made in the interest of safety and are final.
No guarantees are made regarding visibility, marine life, or dive conditions.
8. Equipment
Participants are responsible for ensuring that their scuba equipment is properly maintained and suitable for the planned dives. Rental equipment, if provided, is accepted “as is” and must be inspected prior to use.
You assume all risks related to equipment use, whether owned or rented.
9. Health and Medical Responsibility
You affirm that you are physically and mentally fit to dive. You agree to disclose any medical conditions, medications, or recent illnesses that could affect dive safety.
We recommend dive accident insurance (e.g., DAN). We do not provide medical or evacuation insurance.
10. Travel Insurance
We strongly recommend that all participants obtain comprehensive travel insurance, including coverage for trip cancellation, medical emergencies, and dive-related injuries.
11. Code of Conduct
Participants must:
- Follow all dive briefings and instructions
- Respect marine life and the environment
- Refrain from unsafe, reckless, or intoxicated behavior
We reserve the right to remove any participant from activities without refund for unsafe or disruptive conduct.
12. Intellectual Property
All website content, including text, images, logos, and videos, is the property of the Company or its licensors and may not be used without written permission.
13. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages, including loss of enjoyment, travel delays, or personal injury.
14. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your participation, breach of these Terms, or violation of applicable laws.
15. Governing Law, Venue, and International Travel
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
You agree that any dispute, claim, or legal action arising out of or relating to these Terms, the website, or participation in Company-organized trips—including international travel and diving activities occurring outside the United States—shall be brought exclusively in a court of competent jurisdiction located in the State of Florida.
You further acknowledge that:
- Diving and travel outside the United States may involve additional risks, laws, standards, and emergency response limitations
- Medical care, evacuation, and legal remedies may be limited or unavailable in certain foreign jurisdictions

We may update these Terms at any time. Continued use of the website or services constitutes acceptance of the revised Terms.
